What's on this agenda

Orange County's Planning Board decides whether to recommend a conditional rezoning at 1039-UT NC 86 North to the Board of Commissioners. The rezoning would move 78.11 acres from Agricultural Residential to a Residential Conditional District. It's a 49-lot subdivision that keeps over half the tract as open space.

The board also decides whether to recommend a package of Unified Development Ordinance amendments to the commissioners. The changes cover impervious surfaces, watershed protection overlay districts and stream buffers. Planning Director-initiated, they respond mainly to the state's 2024 Regulatory Reform Act and adjust reservoir setbacks around Lake Orange.

Meeting recap

What happened, drawn from the records published after the meeting. Minutes

The board voted 5-3 to let one additional resident speak on the rezoning, after closing public comment at the September meeting. It then added two conditions. One lets Eno River Academy students, staff and the cross-country team use the site's trails. The other requires the property owner to ask NCDOT for a lower speed limit on the frontage road. Those amendments passed 8-1, with a different member opposed each time. The board voted unanimously to recommend the rezoning to the Board of Commissioners. Commissioners hold their own hearing November 6.

The board also voted unanimously to recommend the Unified Development Ordinance amendments on impervious surfaces, watershed protection overlays and stream buffers. The changes respond mainly to the state's 2024 Regulatory Reform Act. Members asked about Lake Orange's reservoir setback and its connection to nearby water systems. Staff said the lake has no direct intake but keeps the Eno River flowing for downstream users.

How the votes went

The board voted 5-3 to allow one additional resident's public comment on the rezoning (Proctor, Johnston and Kirk opposed), 8-1 to modify Condition 7 on school trail access (Johnston opposed), 8-1 to add Condition 14 on the NCDOT speed-limit request (Yendapalli opposed), and then unanimously adopted the statement of consistency recommending the rezoning. The UDO text amendment package passed unanimously. The September 3 meeting minutes were also approved unanimously.
