What's on this agenda
Orange County's Board of Health considers options for its Groundwater Protection Rules after a recent adjudication appeal invalidated part of its well-setback requirements, ranging from case-by-case enforcement to repealing the local rules entirely. The board also takes up resolutions on affordable housing and on immigration enforcement's effect on access to public health resources, plus a proposed Chair/Vice-Chair slate for 2026.
The board goes into closed session to discuss the health director's annual performance review.

Meeting recap
What happened, drawn from the records published after the meeting. Minutes
On groundwater rules, staff laid out five options after the Gurlitz appeal invalidated the county's well-setback rule tied to the phrase "subject to termite treatment," from clarifying the phrase to a full repeal. Rather than choose an option, the board voted to send the question back to its Ad Hoc Committee on Well Rules to work with staff and the county attorney.
The board approved, without dissent, a resolution promoting the development of affordable housing and a resolution on immigration enforcement and access to public health resources. It also approved a proposed 2026 Chair/Vice-Chair slate, with Tony Whitaker nominated for chair and Brian Crandell for vice chair, to be formally voted on in November. About 14 people have applied for the board's vacant at-large seat, and a committee is narrowing the field to 3-4 for interviews. The board entered closed session at 8:46 p.m. to review the health director's job description and performance, and ended it an hour later.
