What's on this agenda

Orange County commissioners hold a public hearing on rezoning about 61 acres at 3531 NC Highway 54 W in Chapel Hill's Bingham Township, from rural residential to a conditional district for a 43-lot conservation-cluster subdivision. The applicant, Forestar Group on behalf of Carolyn Rigsbee, needs the change after the Planning Board recommended approval 6-3 in August.

The board also considers reviving its Broadband Task Force with an expanded charge, a resolution letting commercial property owners in the county finance energy upgrades through the state's new C-PACE program, and a resolution naming a Cedar Grove Park athletic field for softball coach and civil rights advocate Willie Lawrence Vanhook. The consent agenda covers a two-year Granicus contract for the Visitors Bureau website, animal control contracts with three towns, a chiller replacement at the Whitted Building, and a budget amendment funding a second year of the CARE mobile crisis team.

Meeting recap

What happened, drawn from the records published after the meeting. Minutes

Commissioners approved the Highway 54 rezoning 5-2, over Vice-Chair Hamilton and Commissioner McKee's objections, after four residents spoke against it and a motion to continue the item died for lack of a second. The approved conditions strike a duplicated sentence in condition 10 and drop conditions 8b through 8f. Hamilton said she was not confident in the applicant's water study; the county's planning director said any property can build 20 lots by right without board review, and this proposal added 23 more through the conditional-district process.

The board voted unanimously to reestablish the Broadband Task Force with an expanded charge, appointing two commissioners and reappointing two at-large members while authorizing recruitment for three vacant resident seats. It also adopted the C-PACE resolution of intent, renamed a Cedar Grove Park ball field for Willie Lawrence Vanhook, and proclaimed October as Disability Employment Awareness Month and Domestic Violence Awareness Month. The board approved its full consent agenda unanimously, including the Mobile Crisis Team budget amendment and the 2026 meeting calendar, after pulling item 8-d from the agenda at the outset.

Commissioners also filled the Tax Assessment Work Group's four community-representative seats, naming Neal Bench and Caitlin Saunders for District 1 and John Ferguson for District 2. Commissioner McKee suggested delaying the appointments; no other commissioner agreed. McKee then nominated Horace Johnson for the second District 2 seat, and that nomination failed 1-6, with only McKee in favor, before Commissioner Portie-Ascott's nomination of Kate Millard passed unanimously.

How the votes went

The Highway 54 rezoning passed 5-2, with Vice-Chair Hamilton and Commissioner McKee opposed. The Broadband Task Force charge, the C-PACE resolution, the Vanhook field naming and the two awareness-month proclamations all passed unanimously. The consent agenda passed unanimously after item 8-d was pulled from the agenda; it included the CARE budget amendment, the animal control, chiller and paving contracts, the 2026 meeting calendar and the September minutes. On the Tax Assessment Work Group's community-representative seats, Neal Bench, Caitlin Saunders and John Ferguson were confirmed unanimously; a nomination of Horace Johnson for the second District 2 seat failed 1-6, with only McKee in favor; Kate Millard was then confirmed unanimously for that seat.

Who spoke

6 members of the public spoke.

  1. A new district manager for Duke Energy told the board she will be the utility's contact for the county.
  2. A resident asked for more information about a possible bridge project at Ayr Mount.
  3. A resident asked the board to publicize planning and zoning meetings more effectively and to post meeting outcomes online, and separately asked the board to deny the Highway 54 rezoning over water, septic and traffic concerns.
  4. A resident said the pace of rezoning requests along Highway 54 concerned him while the county updates its comprehensive land use plan, and said the conditional-district process lets decisions bypass a special use permit.
  5. A neighboring property owner who abuts most of the rezoning site asked whether the developer would let his household tap into the development's water system if his well runs dry.
  6. A resident said a left turn out of the development would be unsafe during rush hour and asked the board to deny the rezoning.

The public comment period on matters not already on the agenda drew three speakers: a Duke Energy representative introducing herself as the utility's new contact for the county, a resident asking about a bridge project near Ayr Mount, and a resident who asked the board to publicize planning and zoning meetings more effectively. That same resident and three others spoke again during the rezoning hearing, all opposed to the Highway 54 request.
