What's on this agenda
Knightdale's Town Council holds four public hearings on August 20, annexing and approving development agreements for two subdivisions: Lyndon Oaks (AN-4-25 and ZMA-2-23) and the Haven at Griffith Meadows (AN-5-25 and ZMA-12-22). The consent agenda carries a Traffic Calming Policy update, an all-way stop at Parkside Commons Drive and Village Park Drive, funding for field lights at Knightdale Elementary School, and reimbursement resolutions for fire capital projects and rolling stock.
Also on consent are the Wake County emergency operations plan and mutual aid agreement, street names for the Haven at Griffith Meadows, a stormwater maintenance agreement for Flowers Place, four sets of minutes and a meeting schedule amendment. The police chief introduces a new administrative assistant and new officers, and the mayor reads a Chi Rho Omega Day proclamation. The meeting ends in closed session on a personnel matter.

Meeting recap
What happened, drawn from the records published after the meeting. Recording
Four public hearings, none of which drew a speaker, and all four carried. The council annexed Lyndon Oaks under AN-4-25 and approved its development agreement under ZMA-2-23, then annexed the Haven at Griffith Meadows under AN-5-25 and approved its development agreement under ZMA-12-22. On the Lyndon Oaks agreement one member said he had asked his questions because of the ten-year timeline and did not want to be left with unfinished work, and moved approval once satisfied.
Two people spoke at the general comment period: a composer and a writer describing Jazz Tales, a project funded by a South Arts grant pairing a children's book about instruments learning that their differences are what make them good together with music the composer wrote for it. One written comment came in, from a resident of River Estates Drive about the condition of the tennis courts at Harper Park.
In citizen inquiries a member asked who owns the ordinance distinguishing golf carts from low-speed vehicles, after a constituent's question, and another raised the truck that ran off I-540 at Lynwood Road some weeks earlier. The council closed in closed session. Names here come from automatic captions.
How the votes went
Seven voice votes, all carried with no audible opposition: the agenda, the consent agenda, the AN-4-25 Lyndon Oaks annexation with ordinance 2025-0820, the Lyndon Oaks development agreement with ordinance 2025-08203, the AN-5-25 Haven at Griffith Meadows annexation with ordinance 2025-0820004, that development agreement with ordinance 2025-08205, and entry into closed session.

coming out to our August town council meeting. We are going to go ahead and get started and we are going to start out our meeting with our invocation from Mayor Pro Tim Steve Evans.
Thank you, Mayor. We invite any of those that wish to participate in prayer with us to enter into it this evening or do your own formal medit meditation. Lord, we come this evening asking for your discernment as we go about the business of our community. We ask for you to void us of any personal conflicts or interests. We ask that you give consideration to all of those that have placed themselves in the duty of service, be it elected, be it through our general service teams, through our community service leaders, nonprofits, and first responders. Lord, we ask for the continued grace and mercy upon us all, and that you will continue to enrich our community through the blessings that you so give. In Christ's name we pray. Amen. Amen. Next is our pledge of allegiance. So tonight we are pleased to be joined by the Nightdale Knights Mighty Might football team who will lead us in our pledge of allegiance. So before I ask them to join us at the podium, I'd like to share a little bit about their accomplishments. The Nightdale Football Association is a volunteer-led 501c3 nonprofit organization that has served youth in Nightdale and the surrounding area since 1968. Their mission is to develop young athletes through structured football programs while promoting teamwork, mentorship, discipline, and character development. I want to officially say congratulations to the Nightdale Knights on your 2024 2025 East Wake Football League Championship win. [Applause]
That is amazing. Uh, so this is not only a win for each of you as a team, but this is a win for the entire town of Nightdale.
Yes. Yes. With the trophy. I see it. Yes. Yes. Brought it home. Your success is a true example of what it means to let grit, pride, focus, and determination guide you through the season. I also want to congratulate and thank the amazing coaches. Could all the amazing coaches please raise your hand? [Music] [Applause] Your leadership shows your commitment to the future of our community. Thank you for pouring into our youth and for being examples of service and sacrifice. Because of you, these youth athletes will understand the importance of giving back. I have no doubt that they will pay it forward as they continue to grow and they continue to develop. So on behalf of the town of Nightdale, on behalf of the town council, the Nightdale staff, we say thank you for bringing home that win. We are mighty proud of your achievement and we look forward to the fantastic accomplishments each of you will complete both on and off the field. So know that the town of Nightdale is behind you 100% and we are so proud of you. So at this time I want to uh let's give it up for the Nightdale Knights. A proud round of applause again [Applause] as they make their way up to the podium and lead us in our pledge of allegiance this evening.
I pledge allegiance to the flag of the United States of America and to the republic for which it stands. One nation under God, indivisible, with liberty and justice for all. All right, I'm turn about three three or four rows. There you go. Stagger in between. And then we going to have you Put a little space in right here. Put you right there. Unless [Music] right here in that corner and then you come right here. You come put your head right here. Okay. Cuz his poop going to block you.
All right. You look smart right here.
All right. Look this way. All right, look this way. One, two, three.
Thank you. Thank you. [Music] Can I copy you? Congratulations.
Thank you so much.
Thank you so much,
guys. What do you say?
Thank you. Thank you so much. Once again, another proud moment. So, thank you again for joining us. Thank you for all that you do. Wishing you the best in the next season. [Applause] [Music]
All right. And now we'll move on to our um first the adoption of the agenda tonight. Any changes to the agenda? Questions, comments? If not,
motion for adoption of the agenda. Second.
All in favor?
I.
Any opposed? Majority approves. Motion carries. We'll go with the agenda as is for this evening. Starting with our presentations, recognitions, and awards. First, introduction of police administrative assistant Chief Caps.
Good evening, Mayor and Council. Thank you so much for the opportunity to introduce one of the newest members of the Nightdale Police Department. I'm ask if Tabitha Torren will go ahead and join me here at the podium. As she is making her way to the podium, I want to let you know that we had over a hundred applications for this position. We had so many applications that we had to stop receiving applications. My friends in the HR department did a really great job of narrowing those candidates down and gave me a a great handful of potential applicants and uh through that selection process, we identified uh Tabitha as our next administrative assistant. Now, Tabitha has a wealth of experience in both the private and the public sector. She's also no stranger to public service. She used to be a dispatcher for the Wake Forest Police Department. She comes to us from North Carolina State University Police Department where she served as the administrative assistant there. Uh she is a graduate of Windgate University and is currently pursuing her MERS in public administration uh at the University of North Carolina in Wilmington. And so the caliber of experience and talent that we were able to find uh in Tabitha is is truly uh impressive. Um and and non-sworn employees don't always get the same type of treatment in this space as our sworn officers do. But I want to take just a moment of privilege uh to kind of offer a word of encouragement to uh to Tabitha. Our nonsworn staff play such a vital role uh in the delivery of our mission and the way that we serve our community. We absolutely could not do it without the people who are working
diligently day in and day out behind the scenes in ways that don't always get recognition in ways that you can't always see with a uniform and a badge to make us successful. And as much as those five rules apply to our officers, they apply to you as well. Uh you again, you you play an integral role in our mission. Put that mission first. Everything that you do is the first face of the Nightdale Police Department. When you're engaging with members of the public, let it reflect our core values. Just be 100% honest 100% of the time. Remember your commitment to the profession that you've chosen and always give everything your best effort, which I know that you will. Everything else has a way of taking care of itself if you do that. Tabitha, we're proud of you. Thanks for being a part of this team. Tabitha council. Council Tabitha. [Applause] Welcome Tabitha. We are so glad to have you. Thank you for choosing Nightdale. Um and we look forward to the great thing that you things that you will do here. So glad to have you. Next is the introduction and oath of police officers. Chief Cats. Thank you again, Mayor. Uh as you know, this is a very special time uh for our organization uh both the police department, for our local government as a whole. Uh it's always an exciting privilege for me to be able to come forward and talk about the new officers that are committing themselves to our police department. Uh and tonight we're going to be doing an oath of office for three new police officers. These gentlemen are no stranger to uh public service. Uh and as I call them out by name, I'm going to ask that they will join me up front uh along with their families as well. And I believe Mayor, you're going to help us out with the uh with the oath. Um first, I'd like to introduce Mr. Connor Ashley. Uh Connor Ashley actually comes to us from the Wake Forest Police Department. Uh he is a resident of of Wake Forest. Uh sort of a lifelong uh resident here of Wake County. graduated from the basic law enforcement training program at Wake Tech. Uh very very fortunate to have him along with us. Uh I also like to introduce Mr. James Lynch. James Lynch is a five-year veteran of law enforcement. Uh he spent the last 5
years serving uh the Durham County Sheriff's Office, a graduate of Enllo High School, um and someone who brings an amazing amount of talent and skill to the department as well. And last and certainly not least, Mr. Orlando Rousario. Now, Orlando has over 20 years of law enforcement experience, has worked at a few different agencies in the eastern part of the state. Um, he uh comes to us as a former United States Marine. Uh, spent some time there uh in in the armed services achieving the rank of sergeant. Uh, also uh comes to us as a graduate of Columbia University with a bachelor's degree in criminal justice. So, this is a good-looking group, a group that represents a tremendous amount of talent. Um, and with that said, we are going to get these gentlemen sworn in and then I'll issue a public challenge. Mayor, if you will. You want me to hold it?
I think you can hear me. We're good. Okay. We're going to start out and I'm going to say I and then you're going to state your name and then after that you're going to repeat after me. So, first I and state your name. And then repeat after me. Do solemnly swear
Do solemnly swear
that I will support and defend
the Constitution and laws of the United States
and the Constitution and laws of North Carolina
and that I will faithfully discharge
and I will faithfully discharge the duties of my office as police officer.
The duties of my office as police
So help me God.
Congratulations [Applause] Good job. As the families making their way back to their seats, I I want to kind of point out that it really does take that kind of support structure uh in order for our men and women in uniform to be able to do that job. Uh it's often uh thankless in terms of the sacrifice that the families make, but truthfully uh the these men and women couldn't do their job without support structure at home. Um and to have so many friends and family here this evening uh showing their support for them truly is a a testament. Uh gentlemen, before we uh part ways this evening, you know what's
coming. We've talked about this a lot. This is an important public challenge that I issue to you in the presence of these men and women and presence of the elected officials who represent our community. Everything that we do in our organization boils down to a handful of very simple but powerful principles. We commonly refer to them and affectionately refer to them as the five rules. Rule number one is pretty simple. The mission comes first and our mission is about other people. No personal preference, no personal relationship, no uh bias that we have can come before the mission. The mission is always priority number one. Rule number two, your behavior, your engagement. The way you make your decisions has to be commensurate with our core values. Our core values represent the things that are most dear to us. So when you go out there and you engage and when you serve, always do it with those core values in mind. Rule number three, tell 100% of the truth 100% of the time. It's not always easy. The truth is not always popular and sometimes the truth has its own consequences, but it's always the right thing to do. Rule number four, never betray this oath. You didn't swear your oath to an individual. You certainly didn't swear allegiance to me or to any of the members represented here, but you swore an oath to ideals and principles that hold our constitutional republic together. You swore an oath to put others first. This is an important public promise and outside of your wedding vows, it may be one of the most important promises that you'll ever make. Don't break it. Last but not least, rule number five. Give everything your best effort. I do not expect you to be perfect. I don't think the people that you serve expect you to be perfect, but I do think that they expect you to always give your best. The people that you see here deserve nothing less. The people that you work with deserve nothing less. Ladies and gentlemen, I'm here to tell you from experience, if you will take care of these five things, everything else has a way of taking care of itself. I am proud of you. Welcome aboard. We're expecting
great things. Now, go out there and do some good. Just go back to the center. [Music] One more. Perfect. Thank you. On behalf of the council, once again, we welcome you to the town of Nightdale. We are so glad that you are here and just as chief stated, we look forward to the great things that you do here. So awesome. Thank you. Next is the proclamation for for a Cairo Omega chapter of Alpha Kappa Alpha Sorority Incorporated. So we do have an official proclamation and I will read that proclamation at this time. Whereas Alpha Kappa Alpha Sorority Incorporated, established in 1908, is the first Greek letter organization founded by African-American college women, built on the pillars of sisterhood and service, and now boasts over 355,000
members worldwide. And whereas the Cairo Omega chapter was chartered on August 28th, 2004 by 26 visionary women from the East Wake Ivy Club under the leadership of Midatlantic Regional Director Dr. Caroline L. Latimore to bring the mission of Alpha Cappa Alpha Sorority Incorporated to the underserved communities of Eastern Wake County. And whereas since its founding, Cairo Omega Chapter has worked to uplift the community through impactful programs in the areas of health awareness, youth enrichment, environmental sustainability, civic engagement, and support for economically disadvantaged families. And whereas the chapter has made significant contributions to the town of Nightdale through initiatives such as college readiness programs at Nightdale High School, wellness education, scholarship distribution, voter registration drives, and environmental service projects. And whereas Cairo Omega chapter continues to grow in membership and outreach, living out the sorority's international theme, soaring to greater heights of service and sisterhood while upholding its founding commitment to excellence and advocacy for families and communities. And whereas August 28th marks the official chartering date of the Cairo Omega chapter and serves as a symbolic reminder of the chapter's legacy, service, and continued impact throughout Nightdale and beyond. Now therefore, I, Jessica Day, mayor of the town of Nightdale, do hereby proclaim August 28th, 2025 as Cairo Omega Day in the town of Nightdale and encourage all residents to recognize and celebrate the contributions of the members of Cairo Omega chapter of Alpha Cappa Alpha Sorority Incorporated to the betterment of our community. [Applause]
I know we have several members in the audience here. We just want to say thank you so much for your service to the town of Nightdale. Thank you for your continued support. We appreciate all that you have done and appreciate everything that you have planned and will do in the future. Um it is very impactful to our community and we just want to say thank you. And so now we will take a picture. I think we have the president here. We have the official proclamation. [Music] [Applause] All right, this way. Smile. Everybody's in it. Either you can pop out or however you want to do just so we can see everybody. this way. One, two, three.
Good job. Thank you. Thank you. [Music] as they are leaving. Once again, we are so appreciative of our community partners who are willing to serve our community, who are willing to give back, and we're thankful anytime we get a chance to recognize them and share the great work that they are doing in the town of Nightdale. Next on the agenda is the public comment period. Is there anyone here tonight who wishes to address the council on anything that is not currently on the agenda? If so, you may come forward at this time. And as you are coming up, I just want to share just one thing. Public comment is an opportunity for individuals or groups to bring potential topics of interest to the council's attention. It is important to note that it is not a discussion or an impromptu agenda item. The council will receive information. Take it under advisement. Respectful communication is expected and appreciated. And for anyone speaking tonight, please make sure to
sign the speaker sheet. If you have not signed the speaker sheet, please make sure to do that. And comments are limited to 3 minutes. We do have a timer at the end of the table here that will indicate the time. Um, and please be sure to state your name and address for the record.
Hello everyone and thank you for having us. My name is Greg Gelb and this is Trinity Berscie and we are co-creators of a project uh that's going to do something for Nightdale we hope. Um I received a grant from the South Arts Organization to uh work with Trinity on a project that we call Jazz Tales and u I'm a composer of music and a jazz musician. Um, our first project together, um, was Trinity wrote a book. I'll let her tell you a little bit about the book. And then I wrote music to go along with the book.
Just really quickly, so the book is about instruments who are playing together in harmony. They're having fun. Then they think because they're different, they shouldn't play together. The whole town goes haywire. So in the book, at the end, they get back together, they realize that actually what makes them different makes them pretty awesome. So it's a great message and a fun story,
right? So, we're going to have a concert, a public concert on September 13th at the Nightdale Recreation Center. And following the concert of Jazz Tales, we're going to have an open community discussion and we want to find out more about the community, what what issues are going on in the community um so that we can develop a new story. Trinity is going to write a new story. I'm going to write new music to it and we're going to perform it back here in Nightdale in the spring after it's all done. Anything else you want to say? We We'd like to have as many people uh from uh the community come out, different people that have, you know, different uh things they're working on and maybe we can bring the community together in in some way.
Thank you so much for sharing. I appreciate uh sharing the information with us. Hopefully we can get you plugged in possibly with our community relations department uh so that we can share information that's happening in the town of Nightdale. You can share information with us and see if there's a way um that the things that you were doing we can help support and vice versa. So we appreciate it. Thank you. and anyone else
um good evening. Um I kind of hate to come behind wonderful evening that I just saw the police being um recognized and the young football team and the Kappa. I do have some concerns. Um
please state your name and address.
Yes, my name Trina Lewis. Um I live in Nightdale. I'm a resident. really don't want to share my address, but um I'm just really really concerned.
We do need your address for the record.
Um
have you signed it on the speaker sheet?
I will.
Okay.
Yeah. Thanks. It's okay. So um I'm in Nightdale and um I live off of Grasshopper. So um I just been really noticing that I spoke to a lot of people through the NC DOD. Um, I'm in I spoke to Gwen, I spoke to Jeff, I spoke to the public works. Um, I'm going to say this, the Nightdale Station Park is beautiful. It's wellkept and it's wellmaintained. However,
when I ride around the city, um, I do a lot of traveling through the different parts of Wake County. I find that it's beautiful like different parts like Raleigh, Apex, Vquina, um, Kerry. I even took the back roads just to see was I missing something. But I find that Night Del has a lot of trash around off of pool roads, Melville Road, extremely bad on grasshopper. And um this will be like my fourth inquiry and it's going unheard. So I just was wondering I was told that they only come out twice a month and the highways almost got in an accident. There was so much trash um coming off um going on to I 87. So, um, I keep tell people keep telling me that I'm in the wrong division. They don't handle this. So, I just was wondering when do they really come pick the trash up? Like they throwing mattresses, dressers, trash, tree limbs are hanging over and it's like all through night. So, I didn't know who to come to. So, I'm coming tonight cuz I'm on the portal. It's my fourth time on the portal. People calling me but they're not coming through. I just rolled up Grasshopper. It's 12 Oh, actually was 22 trash spots. Just trash on both sides. And I just want to know who handles that. It's I mean when you get off at exit 9, Smithfield Road, Pool Road, Hydro coming on I7 North, I40 East, soon as you get past Garner all the way down to
Windendell, it just seems to change to a lot of debris, plywood, couches, mattresses, styrofoam, And then I was told it's contracted. So today I was riding and I'm
and we can we can gather more of your information.
Um
on a portal.
Okay.
And I sent Heather Smith. Um I went down to NC do on Blue Ridge the maintenance department. And another thing
and what we can and what we could do this evening is if we could get a staff member directly from this evening um maybe one of our assistant managers to connect and then be able to answer some of those questions that you have and make sure that we get those answers to you and that we let you know that your concerns are heard. So, thank you for being here this evening and thank you for sharing those concerns.
Thank you for sharing those concerns. We do have a time limit for our comments. We we do have a time limit for our comments and so we appreciate you sharing your comments
and we would love to have more conversation about that but thank you for sharing this evening.
Thank you.
Please make sure we get you connected before you leave. Is there anyone else here tonight that wishes to share any comments? All right. I know we have some written comments, so I will turn it over to our town clerk, Mrs. Smith, to share our written comments.
Good evening, mayor, members of the council. We did receive one written comment for tonight's public comment period. Since you've all received this comment via email, I'll just briefly summarize. Janetta Bonds, 7001 River Estates Drive, expressed concerns
regarding the condition of the tennis courts at Harper Park. Um, the full comment will be included in the official record of the meeting. Thank you.
Thank you, Mrs. Smith. Next is report on citizens inquiries. Any reports on citizens inquiries from council?
So, I did have one. Um, and I don't need a response tonight, but uh, golf carts came up. Uh, a resident in my neighborhood was asking me about it. Um, and the distinction between golf carts and lowspeed vehicles. Um, so I was just wondering who owns the ordinance and and how I can how I didn't know the answer, so how I could find that answer for her. Um, I spoke with the town manager about this one. Um, the incident at um on I 540 at Lynwood Road u where the truck ran off the road um several weeks ago. Fortunately, it was at a time of day when no one was um on Lynwood driving or or walking and and thankfully I think there was no serious serious serious injuries or even deaths from it, but it was a serious accident. Uh the comment was um could more have been done as far as safety, you know, guard rails, height of barrier rail, that type of thing. Um and anyway, it's it's a question that uh it's a mention to the town manager. We'll we'll investigate and try to I think um get the appropriate response from NC DOT who owns that facility uh to see if we can um get an appropriate response from them. Um, another one, um, I get I just give kudos to, uh, Neighbors and Planners Walk for what I understand just a few days ago, washed all of the signs out in the neighborhood, street signs, um,
neighborhood signs, um, speed limit signs, every sign out there. And it's something we don't normally um, expect them to do, but I just want to give them kudos. And I know that those signs are and a lot of signs around town are it's my understanding we're looking at a replacement schedule uh as some of those are starting to to be 30 years old some of them and and much older but anyway kudos to them for for taking that initiative.
Awesome. Thank you.
All right. Then we'll move to our consent agenda. Are there any questions or comments about the consent agenda?
Move approval of the consent agenda.
Second.
All in favor?
I.
Any opposed? Majority approves. Motion carries. Next, we'll move to our public hearings for this evening. First public hearing and-4-25, Lynden Oaks annexation. Mr. Smith.
Thank you, Mayor Day. Good evening, council. Uh the agenda so far has been fun and exciting. So let's continue this with land use annexations and development agreements. First item for a public hearing is AN4-25. This is the Lynden Oaks plan unit development uh annexation. Uh as a reminder, this this item came before council last month in July 2025. Uh at that time the um final touches on the on um the development agreement um were not were not finalized. So the applicant wanted to um move the annexation along with that development agreement. So they requested a continuence um to be heard at this uh public hearing to tonight. So as a reminder uh what is before you is a voluntary non-ontiguous annexation petition for uh Lynen Oaks. Uh right now uh the subject property is is located um
between Oldfacing Road and Bethlehem Road towards the southern extent of our uh ETJ. Uh what is the current use is some residential uses but it's largely agricultural and vacant. Um, but if you recall, uh, summer of of last year, uh, proposal for Lynen Oaks was was approved by town council, uh, that would allow up to 500 residential, uh, units and it established about a 2 acre non-residential or commercial out parcel as part of that development. Um, so this is, uh, one of the the final pieces um to the the public process and the reasonzoning. Um, so this annexation petition has been um, submitted. Uh it was uh verified, the application was verified by our our town clerk. Uh in June on June 18th, we uh set the public hearing um so that we were able to hold this um and then also all public hearing advertisements have been met again to hold this uh annexation hearing. So just a reminder, this is the approved master plan from from July of 2024. uh shows a variety of of single family duplexes um and and town homes throughout. Um and again it's been approved already for up to 500 units. Uh here is a uh this is the annexation plat itself um that you know if this annexation is approved by town council this would be recorded in the register of deeds. Um as part of every annexation staff does look at the projected revenues and expenditures uh for at the annual basis. Uh based on 500 units u residential units uh the total um net positive or projected net revenues would be over $340,000 per year. Would like to note that this is only considering up to 500 residential units. Uh, as I mentioned, there is a commercial out parcel piece to this. Um, that would include some uh commercial
neighborhood scale u commercial. Um, those would of course bring in additional revenues, but it's just not captured here in this this analysis. Um, some other things to to consider alongside this uh this annexation petition is uh through through the approval process and and working with the applicant and developer uh they have committed to several off-site uh roadway improvements. Uh they've also uh committed to extending water and sewer to this area and and allowing greater extension to to adjacent properties. Uh the development is also including over a mile of public and private trails and then over a mile of uh public collector streets. So in addition to the uh the analysis, you know, the the benefits that we were were able to measure, these are just a couple other things to to consider as as other benefits with this development. And so with that, I'm happy to answer any questions you may have. Uh as a reminder, the next agenda item will be the development agreement that's associated with the with this Lynen Oaks. But uh being that the uh public hearing is open from last month, my recommendation would be after receiving public comment make a motion to close the public hearing and adopt ordinance 20 2025820 which would effectively annex this area in the town limits.
All right. Thank you so much. Any questions or comments? All right. This is a public hearing item. So, at this time, we'll open the floor. Is there anyone here tonight who wishes to speak on this item? If so, you may come forward at this time.
All right. Hearing none, we'll bring it back to council. Any last comments, questions? I'll make a motion to close the public hearing and adopt ordinance 2025 0820 effectively annexing the area.
Second.
All in favor?
I I.
Any opposed? Majority approves. Motion carries. We'll move to our next item which is ZMA-2-23 Lynden Oaks development agreement.
Thank you, Mayor Day. So, this now that the annexation has been uh adopted, the next piece is the development agreement um for the same project. Um again, as I mentioned, this this uh item was brought before council back in in July um for for consideration. uh there there were final pieces uh that needed to be um cleaned up related to off-site roadway improvements. Um so again, that that's why the request for continuence was made back in July. Um and it was uh granted by by council to hold this hearing tonight. So to share a little bit more about the project, again, it's about 175 acres in size. Uh the project's entitled uh Lynen Oaks. It's a plan unit development with uh residential mixeduse zoning. Uh the applicants Parker Poe developer is Dr. Horton. Um and again what has been approved up until this point is up to 500 residential units and uh 1500 square ft of commercial uh uses on about 2 acres. Um so looking at the zoning of the area, it's predominantly residential uh in nature on on all sides. And again, here's here's another uh look at at the master plan. Um happy to to dive into this, provide any details about what's being proposed here. Um but looking at at the timeline again, the uh plan unit development for Lynen Oaks was approved back in July uh 17th of 2024.
Uh that slide's incorrect. So now we are had the annexation hearing and then now here at the development agreement pending the results of of this hearing the the applicant would finalize their construction drawing. So you know the the the fine detail uh of plans to start construction um and then after that takes place construction improvement permit would be issued and then we would be starting to look at building permits out here. Um, but as you're all aware, development agreements are a tool for local governments um to uh really dive into how public utilities are are going to be served to the area. We have a water allocation policy that that's a very important tool um for whenever folks are trying to connect to water and sewer. Um but overall development agreement sets the sets the general expectations and establishes the terms um and conditions and uh really details the commitments that the the applicant the town and all parties uh are committing to uh moving forward. Um so the water allocation policy this was you know reviewed during the the resoning uh it remains the same remains compliant. Um so uh there there's no um concerns with with compliance with this. Um but the again the development agreement uh details this and uh ensures that the applicant is remains committed to installing these improvements. This project will be built within four phases over a 10-year period. Uh so with this uh development agreement, it outlines at what point in the number of units will will come online um and and it extends the vested right period from a 2-year approval period out to to 10 years. So uh they would have until year 2035 uh to construct uh up to 500 units and uh the commercial out parcels. Just as a reminder, there were several zoning conditions that were committed to through the resoning. So just uh all
those uh zoning conditions will remain in full effect. Um they become incorporated into this development agreement. So again, it just shows uh additional commitments um and and sets the expectations on on what this development will look like. Um but in general it's related to different site development allowances agreed upon architectural standards, site design itself, the commercial use standards and then uh both on-site and off-site transportation improvements. So with that again that concludes my presentation. I'm happy to to dive into any specific details or answer any questions you may have, but it would be my recommendation that after receiving public comment, make a motion to close the public hearing, approve the development agreement, and adopt ordinance number 2025 08203. Thank you.
Thank you. Again, any questions or comments on this one?
Uh hopefully straightforward. uh what infrastructure and amenity besides the stuff directly like the street in front of the phase would not be built until the phase three or four got built.
Sure. So I have a so this is from the off-site uh phasing study that the applicants traffic engineer put together and you know the the point of this is this is the the result of of the study. But what this is showing is that at crosscut and site access B you know that roundabout and that main site access will be constructed at at day one before anything you know happens. um in the blue in the blue towards or right above this square with the site. Um that's also site access. Um it's their second entry point. So they'll be uh constructing that. Um you know before the 101st CO that's directly tied to fire code requirements, making sure there's adequate access. Um from there uh we'd be moving to the intersection of
Oldfasin Road in Bethlehem where there would be additional lanage added and then a signal um installed at that intersection um and then it would move down to Pool and Bethlehem um where there'd be some some turn lanes um installed and then finally move over to Hodgej and Oldface and where some other uh intersection improvements would be made. So about every hundred um units the more offsite improvements, roadway improvements will be coming online.
And as far as they they had a amenities uh I think there was pickle ball, there was a clubhouse.
Yeah. Yeah. So there's an internal amenity center uh that would be constructed within phase two um of the development. So really the only thing held for three and four would be a greenway back there
for Yeah. for for public amenities and Okay. Yeah.
Thank you.
All right. Any additional? If not, thank you. We will open up the public hearing. Once again, this is a public hearing item. Is there anyone here tonight who wishes to speak on this item? If so, you may come forward at this time.
All right. If not, we will bring it back to council for any last comments, questions.
I'll comment and motion. Um, just commenting. The reason I asked those questions is because of the 10-year timeline. Um, and I didn't want to be left with a bunch of stuff incomplete. Um, but with those answers, uh, I'll make a motion to close the public hearing, approve the development agreement, and adopt ordinance 2025 08203. Second.
All in favor?
I.
Any opposed? Majority approves. Motion carries. We'll move to our next one, which is an-5-25 Haven at Griffith Meadows annexation.
Good evening again. Uh, so we will keep on moving. We'll go a little bit southeast of um of Lynen Oaks, but this public hearing is for A&5-25. It is the public hearing for annexation for the Haven at Griffith Meadows Plan Unit development. This project was approved u back in November of 2023. So, it's had a little bit more time in between um time here at town hall um and and this this application. But again, this is another voluntary non-ontiguous annexation um petition. Whenever the Haven at Griffith Meadows was approved back in 2023, it would allow for 180 residential lots. Uh looking at uh the location of it, it's it's on the north side of of Pool Road. Uh again, towards our southeastern most jurisdictional limit in our in our ETJ. Right now the the property is largely vacant, some residential use and uh maybe some some agriculture. This uh item was certified by by the town clerk. Uh so the the annexation petition that is um back in uh July, mid July, we also uh set the public hearing so that we could come before uh council to discuss this and and hold the public hearing. And then staff also met statutory and UDO requirements for for public advertisement. Here's the master plan. So it shows you know on the southern end um you know overall there there's there's 180 units. Uh the center is kind of biseected by by some environmental features u with a with with a major spine road running through through the center connecting
these two uh sections of the neighborhood. Here's just the uh the annexation plat. Again, if if this were um to be adopted by town council, they would record this plat in the register, the that would annex it into town limits. With all annexation that we look at, you know, costs and benefits and and the projected revenues and expenditures based on 180 residential units, the projected net revenues would be positive $16,000, slight slightly over that. So there'd be a net positive if this uh petition were to be adopted by council. Similar to the last case, there are some other commitments that have been made that should be noted. Again, water and sewer will be extended to uh this area which which provides other options for for future residents in the vicinity having greater access. uh throughout the development. They're also building about half mile public and and private uh trails and then they're also constructing about a half mile of uh collector streets throughout the development. As always, I'm I'm happy to answer any questions, provide more detail. Um but it's my recommendation that after receiving public comment, make a motion to close the public hearing, adopt ordinance number 20258204, which would effectively annex this area in town limits. Thank you.
All right. Thank you as well. Questions or comments? All right. Thank you. This is another public hearing item. If there's anyone here tonight who wishes to speak on this item, you may come forward at this time. If not, then we'll bring it back to council. Any last questions, comments on this public hearing item?
All right, seeing no questions or discussion, I will make a motion to close the public hearing, adopt ordinance 2025 0820004, effectively annexing the area.
Second.
All in favor?
I.
Any opposed? Majority approves. Motion carries. We'll move to our last public hearing item, ZMA-12-22, Haven and Griffith Meadows, the development agreement. Thank you, Mayor Day. So, this is my last time at the podium uh directly related to the last annexation. This is the uh development agreement for ZMA 12-22, which is the Haven at Griff Meadows plan unit development. Um again this this site is located towards our our southeastern most extent of our uh what is now town limits. Uh the project is entitled Haven atet Griffith Meadows. What the zoning district that was approved um was a general residential three plan unit development. Parker Poe is the applicant. Meritage Homes is the uh developer here. The site's about 60 acres in size. Again, what was approved was 180 residential units. Looking at the uh zoning in the surrounding area, sub property zones GR3 plan unit development to the west is largely low density uh residential or or vacant parcels. Um to the south and east are Wake County jurisdictions. Again, here is a uh uh the master plan itself. happy to dive into it and tell you all the details about it. So, just feel free to answer ask me any questions about it. Um, again, plan unit development was approved November 15th of 2023. We've been working with uh the applicant and developer for some time on construction drawings. So, we're here tonight uh to discuss and consider the development agreement um following this. Um if it's adopted, the construction
drawings will be finalized, construction improvement permits would be issued and building permits would be reviewed and issued. Again, this development agreement is an an important piece of of the public process and the uh resoning. The as I mentioned, this this project will be bringing public water and sewer to the area. So, uh it's important to capture uh you know, what that means to the development and how it impacts our water allocation policy. And then overall it just sets the expectations, establishes terms and conditions and details commitments moving forward for all parties. During the resoning water allocation policy was reviewed and it was found to be compliant uh with that policy achieving the 50 base u 50 points required through a variety of of amenities. This uh project was proposed to be built out in two phases um over over a seven-year term. Um, so in in phase one on the southern part of the site would be about 120 uh lots and they'd be committing to to delivering those units by the end of 2028. Uh the remaining 60 lots will come in as phase two towards the northern end of the site uh with a commitment of uh coming online the end of 2030. There were also several zoning commit conditions that were uh committed to through that that res zoning process. So just a reminder, those zoning conditions will remain in effect in effect and carry forward into this development agreement. It really just details the site development allowances, the architectural standards, general site design, and then other electric vehicle and sustainability uh standards and components that they've committed to to bringing to this neighborhood. Uh, as always, happy to answer any questions, provide more details, but it's my recommendation that after receiving public comment, make a motion to close the public hearing, approve the development agreement for Haven at Griffith Meadows, and adopt ordinance number 20258205. Thank you.
Thank you as well. Any questions or comments on this one? So there there were some um I think this is the same site that has a few existing u mobile homes on this site if I'm not mistaken. Has that been addressed in the developers agreement? What what's going to be done with those?
So I so you're I remember you know last month we talked about the adjacent property and similar situation. So we had Hopican Farm come forward for joint public hearing. I just want to make sure we're we are talking about the homes on on Havenick or Griffith Meadow. Um
I'm not sure if that's what that is on Hoppy Hill Drive. Um but I didn't know if that was the same situation here.
Yeah. So so there were there were different ownerships of of this 60 acres. However, at this time it is now all owned by um the developer. Um, so I would think that um there have been um decisions made on on the living situations of the folks that are out there today. And I know there's still, you know, other parts of this process, should we approve this? But just, you know, all consideration if there are folks that live out there, especially mobile homes, to give them plenty of time, any available resources to relocate. Um it certainly will be my expectation, you know, for us to to do well by those citizens that have um you know, probably affordable living situation now that could be very difficult to find other places certainly in Wake County.
Understood. Thank you. There are none other then we will open the floor for public comment. This is a public hearing item. If there's anyone here tonight who wishes to speak on this
item, you may come forward at this time. All right. If not, then I'll bring it back to council for any last questions or comments or motion.
I'll make a motion to close the public hearing, approve the development agreement, and adopt ordinance 2025 08205.
Second.
All in favor?
I.
Any opposed? Majority approves. Motion carries. And that concludes our public hearings for this evening. So, next we'll move to advisory board and committee reports. An opportunity for council members to share any updates from recent advisory board meetings. Does anyone have any updates to share?
Not really advisory board, but parks and recck, you know, put on their uh arts and education festival, did a fabulous job. Um, I I thoroughly enjoyed it and and think it uh it definitely did its job building community and and helping support education in Eastern Wake County. So, thank you. Yes. Thank you. Any additional?
All right. If not, then that concludes our regular meeting. We do have to go into close session this evening. So, may I have a motion to enter into close session pursuant to North Carolina General Statute 143318.116?
So, move and second. All in favor?
Any opposed? Majority approves. Motion carries. So, we'll take a short break and then we will go into closed session.
